NBA scores: Heat, Magic lose to 2 of NBA's worst teams

Both of Florida's NBA franchises suffered embarrassing losses on Friday night.

With Dwyane Wade out due to a suspension, the Miami Heat were stunned on Friday night in the Motor City, losing 109-99 to the Detroit Pistons.

LeBron James led all scorers with 35 points, and Chris Bosh had a terrific game finishing with 28 points and nine rebounds. However, the rest of the Heat players combined to score just 36 points on 13-of-38 shooting. Miami lost the game in the second quarter, more or less, as Detroit outscored the defending champions, 41-20, in the period. With the win, the Pistons improved to 10-23 on the season, while the Heat fell to 20-7.

In the nation's capital, the Orlando Magic fell to the woeful Washington Wizards, 105-97. Wizards' reserve guard Jordan Crawford scored 27 points off the bench, while Nene added 23 points and 11 rebounds. Washington outscored Orlando by 14 points in the middle two quarters and held on in the fourth for a rare victory.

The Wizards are now 4-23 while the Magic, who continue to be mired in a downward spiral, dropped to 12-17.

Other scores from around the NBA's Southeast division:

Brooklyn Nets 97, Charlotte Bobcats 81

Atlanta Hawks 102, Cleveland Cavaliers 94

Suzuki Done with Selling Cars in the USA

American Suzuki Motor Corporation is filing for bankruptcy in the USA and will no longer sell automobiles in the 48 contiguous states (all but Alaska and Hawaii). The company is refocusing its efforts on motorcycles, all-terrain vehicles (ATVs) and watercraft, per recently released information from the company. Some of the language of his message relates to other aspects of the automotive industry; we?ll make a few references to national auto transport.

Motorbike & Motorcycles Getting More Attention

ASMC?s Chairman, Takashi Iwatsuki, announced this new move, addressing himself directly to Suzuki motorcycle, all-terrain vehicle, and watercraft customers. The primary focus of his statement is that there will be no interruption in business and no changes ? other than higher prioritization ? for the non-automobile branches of the company. Suzuki will also continue to market itself widely via motorbike and motorcycle racing ? a continuation of its current practices. As Suzuki cars and trucks become more limited, wise businesspeople will look into transporting the car from state to state to deliver it to the best possible markets for sale.

Over 100 Years of Business

Suzuki has been in business since 1909. Its first motorcycles were manufactured in the 50s, in which it released the Diamond Free (1953), which had the basic look and feel of a bicycle, and the Colleda COX (1955), which had the style and structural integrity we tend to associate with the modern motorcycle. Antiques such as these require special care. When looking at moving a treasured motorcycle or
understanding how to transport across country, it?s important to find a reliable firm.

Fundraising

Suzuki sponsors a number of professional racers, including Josh Hill, who is new to the lineup in 2013. The company also builds corporate giving into its relationship with sponsored riders. In November 2012 Chris Ulrich raised over $6000 in a fundraiser: he did so by taking 71 people each for a 6.9 mile ride at Fontana, California?s Auto Club Speedway. Fundraising is a good way to give.

Expenses Just Too High in the United States

According to Iwatsuki, Suzuki decided to shut down American automobile sales due to flagging volume, a low model quantity, and difficulties specific to operation in the United States ? the general expenses of operation in a highly competitive economic climate and the necessity of complying with strict laws and codes. The issue of expense also relates to acquiring quality, online quotes, which can significantly decrease costs.

Current drivers of Suzuki automobiles will not be left out in the cold, according to the release. Cars currently with dealers in the United States are still available for sale, and Suzuki hopes to maintain its relationship with these customers throughout their ownership of a Suzuki vehicle.

We Still Ship in the United States

We are also a company that cares about maintaining a healthy relationship with our customers. We get you the best prices in the business via competitive pricing from some of the United States? largest and most well respected companies. Put This Number in Your Cell Phone Today - NOYES LEGAL NEWS

Drunk driving can cause car accidents and death. There is a way to get you and your car home safely FOR FREE if you drank too much this weekend or on New Year's Eve -- AAA and Bud Light's Tow to Go program.

Tow to go4Put this telephone number in your cell phone now in case you need it later -- 1-855-2-TOW-2-GO or 1-855-286-9246. Do it now because you or a friend may need it and may not remember it after a few drinks and hours of celebration.

Since its inception in 1998, Tow to Go has safely removed more than 20,000 intoxicated drivers from the roads. It is FREE and available to both AAA members and non-members. It provides a confidential local ride within a 10-mile radius to a safe location and the AAA tow truck takes the vehicle and the driver home.

According to the Tow to Go Fact Sheet, the tow trucks can take up to two people home. If there are more people in your party, others will need to make other arrangements to get home safely. Also, you can?t make an appointment to use the Tow to Go service because it is designed to be used as a last resort. Thus, it is still wise to have a designated driver before you have your first drink.

Celebrate the New Year with your friends and family, but do it safely. If you have too much to drink (or know someone who has), do not get on the road (or allows them to get on the road) putting others at risk of a potentially deadly car accident.

Phillip Reese

December 29, 2012

Gun deaths and injuries have dropped sharply in California, even as the number of guns sold in the state has risen, according to new state data.

Dealers sold 600,000 guns in California last year, up from 350,000 in 2002, according to records of sale tallied by the California Attorney General?s office.

During that same period, the number of California hospitalizations due to gun injuries declined from about 4,000 annually to 2,800, a roughly 25 percent drop, according to hospital records collected by the California Department of Public Health.

Firearm-related deaths fell from about 3,200 annually to about 2,800, an 11 percent drop, state health figures show.

Column: Set your DVR for Pro Bowl. Now. Seriously

NFL Commissioner Roger Goodell warned players a while back that he was prepared to drop the Pro Bowl if they didn't pick up the level of play. Next thing you know, he'll be threatening to hold his breath.

Instead of calling his bluff, which is what anyone who doesn't get the consolation prize of a week's vacation in Hawaii should have done, they promised to try harder. At the time, it sounded like one of those things kids say just to get their parents off their backs. That seemed even more true this week, when cellar-dwelling Kansas City somehow managed to get five players selected to the AFC squad. That's three more than the number of wins the Chiefs have posted so far this season ? when they were supposed to be trying ? which raises the question: Will anyone who tunes into the Pro Bowl on Jan. 27 be able to tell the difference?

That's the problem facing every pro sport that stages an all-star game these days: It's tough to tell whether anyone's heart is in it anymore. Most veterans would rather take the days off than whatever cash or exposure it provides, and nearly all of them can afford it. More than two dozen passed on an opportunity to show up for last year's 59-41, do-no-harm win by the AFC over the NFC. By the end of that one, defenders were waving ballcarriers by with the kind of flourishes usually reserved for bullfights. Even a solid company man like Goodell had to admit it was an embarrassment.

"If we cannot accomplish that kind of standard," the commissioner said during a radio interview in October, referring to the league's high-intensity regular season, "I am inclined to not play it. It is really tough to force competition, and after a long season, to ask those guys to go out and play at the same level they played is really tough."

Impossible, though, is more like it.

Because the Super Bowl is played at a neutral site, Goodell can't follow the lead of baseball boss Bud Selig and try to coax players into caring about the outcome by awarding home-field advantage to the winning side. There's nothing to be borrowed from the NBA's version, either, because basketball ? unlike football ? can be entertaining without anyone actually playing defense, as fans of the Charlotte Bobcats can attest. And there's no reason to even mention the NHL in this context, because nothing that Commissioner Gary Bettman has come up with during his tenure is likely to be worth stealing.

So what should Goodell do?

Exactly what he's doing now: Pretend to be concerned, and leave it at that.

Despite a few head-scratching decisions this year ? sticking too long with replacement referees; trying to punish the New Orleans Saints more than Bountygate warranted ? Goodell hasn't lost his touch. He's not about to cancel the Pro Bowl. The one lesson that's been reinforced time and again since he took the job five years ago is that there's no such thing as too much NFL ? on the tube, online and even when most of the players are on vacation.

Nearly five million people tuned into the league's scouting combine at some point this spring to watch players who hadn't even made the cut lift weights and run around in shorts and T-shirts. And last year's Pro Bowl game, bad as it was, still pulled in better numbers than any of its rivals ? an average of 12.5 million viewers, even if most of them were asleep by the end.

So Goodell knew exactly what he was doing when he suggested the NFL might skip the game and instead honor the players selected to the Pro Bowls rosters during a ceremony. All-Star games are popularity contests after all, and the NFL's participants are chosen according to a vote among the league's players, coaches and fans, with each group given equal weight in the process.

But if you've followed the arguments about who was left out, you'll find very little griping between the first two groups ? with the possible exception of players who promised the family a week in Hawaii. Instead, it's coming from the same fans who will doze off during the game, but can't for the moment imagine how the Cowboys' Dez Bryant didn't get picked, or how overrated but still popular Green Bay center Jeff Saturday got the nod over linemate Josh Sitton, or why all those Chiefs are hanging around.

So consider this your wake-up call, fans, even if it came a month early.

Vanguard cut fees on dozens of mutual funds, ETFs

(Reuters) - Vanguard Group, the largest U.S. mutual fund manager, reduced fees across dozens of its index-tracking stock and bond funds, following similar moves by competitors.

The fee reductions range from five-hundredths to one-hundredth of a percentage point per year. With many of the funds already charging low fees of less than 0.20 percent Of assets, some of the reductions were the equivalent of a 20 percent fee cut.

Intense competition among managers of index mutual and exchange-traded funds has led to sharp price cutting across the industry over the past few months. BlackRock , the largest ETF manager, and brokerage firm Charles Schwab both announced price cuts earlier this year.

At Vanguard's line of broad equity sector funds, such as the firm's Consumer Discretionary ETF and Health Care ETF , fees declined to 0.14 percent from 0.19 percent. Vanguard, based in Valley Forge, Pennsylvania, posted a full list of the fee cuts at http://link.reuters.com/cut84t.

Vanguard raised fees slightly on three actively managed equity mutual funds, including on both share classes of the $17.6 billion Vanguard International Growth Fund. Fees on the "Investor" share class rose to 0.49 percentage point from 0.47 while fees on the fund's "Admiral" class rose to 0.36 point from 0.34.

(AP) ? He's getting better. He's getting worse. He's already dead. The whole thing is a conspiracy and he was never sick in the first place.

The obsessive, circular conversations about President Hugo Chavez's health dominate family dinners, plaza chit-chats and social media sites in this country on edge since its larger-than-life leader went to Cuba for emergency cancer surgery more than two weeks ago. The man whose booming voice once dominated the airwaves for hours at a time has not been seen or heard from since.

His lieutenants have consistently assured Venezuelans over the last week that Chavez is slowly on the mend and will be back at the helm of the country he has dominated for 14 years. But when will he be back? Will he be well enough to govern? What type of cancer does he have? Is it terminal? If so, how long does he have to live?

Government officials have not answered any of those questions, leaving Venezuelans to their own speculations. The wildest conspiracy theories run the gamut from those who say there is no proof Chavez is even still alive to those who believe his illness is a made-up play for sympathy.

"Everything has been a mystery. Everyone believes what they want about the status of his health," said Ismael Garcia, a leftist lawmaker who belonged to the Chavez movement until a falling-out a few years ago.

Vice President Nicolas Maduro read out a New Year message from Chavez to Venezuelan troops on Friday, but for the fourth day in a row offered no updates on the president's health. Maduro had announced Monday night that Chavez was walking and doing some exercises.

The uncertainty comes with a sense of urgency because Chavez is scheduled to be sworn in for a new six-year term Jan. 10. The government and opposition disagree on what should happen if Chavez can't show up, raising the threat of a destabilizing legal fight. Beyond that, nobody knows if Chavez's deputies, who have long worked under his formidable shadow, can hold the country together if he dies.

Like everything else in this fiercely divided country, what people believe usually depends on where their political loyalty lies. Chavez opponents are mostly convinced that the president has terminal cancer, has known it for a long time and should not have sought re-election in October. His most fervent supporters refuse to believe "El Comandante" will die.

"Chavez is going to live on. He is a very important man. He has transformed the world with his ideology," said Victor Coba, a 48-year-old construction worker standing outside a Caracas church as government officials held a Mass to pray for the leader. "Anyone of us will die first before Chavez."

Coba scurried off to a street corner where officials were handing out a book of photographs of Chavez's recent presidential campaign. The comandante's grinning face looked out from the cover, alongside the slogan "Chavez, the heart of my country."

The same image looms from billboards erected all over Caracas, from freeway medians to the low-income apartment towers being built with Venezuelan oil wealth. Such services for the poor have helped Chavez maintain a core of followers despite high inflation, rampant gun violence, trash-strewn cities and other problems he has failed to fix.

For many, the attachment to Chavez borders on religious reverence. His supporters wish each other "Feliz Chavidad" rather than "Feliz Navidad," or Merry Christmas. Government officials have started talking about Chavez like an omnipresent deity.

"Chavez is this cable car. Chavez is this great mission. The children are Chavez. The women are Chavez. The men are Chavez. We are all Chavez," Maduro said recently while inaugurating a cable car to bring people down from one of the vast slums that creep up Caracas' hillsides. "Comandante, take care of yourself, get better and we will be waiting for you here."

Crowds of red-clad supporters roar their approval each time Maduro reassures them. But on the streets, confusion reigns.

"People say he's going to get better," said Alibexi Birriel, an office manager eating at a Chinese restaurant on Christmas Day.

Her husband Richard Hernandez shook his head. "No. Most people say Chavez is going to die and that Nicolas Maduro is going to take power."

Birriel paused, chiming in, "Well, some think this whole thing is theater and that there's nothing wrong with him."

Hernandez, who described himself as a Chavez supporter but "not a fanatic," shrugged. "The opposition thinks that if Chavez died they are going to win the elections. That is not going to happen."

There have been some official details. Chavez, 58, first underwent surgery for an unspecified type of pelvic cancer in Cuba in June 2011 and went back this month after tests had found a return of malignant cells in the same area where tumors had already been twice removed. Venezuelan officials said that following a six-hour surgery Dec. 11, Chavez suffered internal bleeding that was stanched and a respiratory infection that was being treated.

Just five months earlier, Chavez had announced he was free of cancer. But he acknowledged the seriousness of his illness earlier before flying to Cuba this month by designating Maduro as his successor and telling his supporters to vote for the vice president should new elections be necessary. Outside doctors have said that judging from the information Chavez has provided, his cancer is likely terminal, though the government has never confirmed that.

On Christmas Eve, Maduro surprised Venezuelans by saying he had spoken to Chavez by telephone and that the president was up and walking. With no other details, that only set off another round of furious speculation.

"I don't think he can be standing up walking," said Dr. Gustavo Medrano, a lung specialist at the Centro Medico hospital in Caracas. "Unless ... there are a lot of lies in this and the surgery was not six hours ... but something else much simpler, much simpler, maybe a half-hour operation, or two hours, something like that and that he is now recovering. That is possible."

Chavez supporters tweeted their relief and joy. Opponents tweeted incredulity. They traded insults in the comment sections of newspaper websites. Some posters demanded to know where the proof was that the president was even still alive. Others wondered if he had ever been sick in the first place. Chavez supporters shot back that the rumor-mongering should stop.

One Chavez foe finally posted on the Ultimas Noticias newspaper website, "Bla, bla, bla ... He's getting better, he's dying, he has nothing, he's strong as a bull, he can't get of bed, all the hypotheses are valid because there is no proof of anything."

Amid the raging rumors, Chavez's daughter, Maria Gabriela Chavez, sent out a Twitter message from Havana last week pleading for it all to stop.

"Respect for my family and especially respect for my people. Enough lies! We are with papa. ALIVE, fighting and recovering. WITH GOD," she wrote.

Teresa Maniglia, a press officer at the presidential palace, has kept up a steady stream of cheerleading tweets.

"CHAVEZ all the time."

That's for sure.

U.S. poised to go off "fiscal cliff": Senator Reid

WASHINGTON, Dec 27 - Senate Majority Leader Harry Reid on Thursday warned that the United States looks to be headed over the "fiscal cliff" of tax hikes and spending cuts that will start next week if squabbling politicians do not reach a deal.

Reid, the top Democrat in Congress, criticized Republicans for refusing to go along with any tax increases as part of a budget remedy as he sketched out a pessimistic outlook.

"It looks like that is where we're headed," Reid said of the likelihood of the U.S. economy going over the "fiscal cliff" - with tax increases on most working Americans and automatic spending cuts kicking in next month.

Reid made his comments in a Senate floor speech at the opening of a post-Christmas session, adding that time was running out ahead of a December 31 deadline to act to avert the "fiscal cliff."

Reid urged House of Representatives Speaker John Boehner, the top Republican in Congress, to bring his chamber back into session and to avoid the biggest impact of the "fiscal cliff" by passing a Democratic-backed bill extending low income tax rates for all Americans except those with net household incomes above $250,000 a year.

House Republicans are expected to hold a telephone conference call on the fiscal cliff on Thursday afternoon, a House Republican aide said, adding that a schedule for returning to Washington would be discussed.

Should Congress fail to act by December 31, tax rates for all Americans would snap sharply higher, back to pre-2001 levels, and two days later, $109 billion in automatic spending cuts would start to take effect. Together, the higher taxes and lower spending would suck about $600 billion out of the U.S. economy, potentially causing a new recession in 2013.

On Wednesday, it was Boehner who urged the Democratic-controlled Senate to act first to avoid the fiscal cliff, offering to at least consider anything that the Senate produced.

Reid returned the volley on Thursday, saying that the Senate had already acted, and the Democrats' solution needs the consent of both Boehner and Senate Republican Leader Mitch McConnell.

Reid said Boehner "has just a few days left to change his mind" on the Senate bill. "I don't know time-wise how it can happen now."

New year, new business structure? - Law Office of EC Lewis, PC

This month?s blog series has been focusing on preparing for the upcoming new year. The first week of December, we talked about business planning and last two weeks we have talked about real estate and equipment leases. For that last post in this series, we are going to talk about changing your company?s legal structure.

When we talk legal structure, we are talking about the way that your company is treated under the eyes of the law. There are four main legal structures in Colorado that companies are organized under: sole proprietorships, partnerships, LLCs, and corporations. There are several others but those are typically less common for companies (for example, non-profits and co-ops) so we aren?t to discuss those today.

Sole proprietorships are set up by default when someone goes into business by him or herself and doesn?t set up an LLC or corporation. In some cases, people set up sole proprietorships intentionally for a variety of reasons including ease of setup and small liability issues. Standard partnerships usually are setup for similar reasons ? by default because two people start working in a business. Both entity types can be appropriate for some situations. However, the situations are few and far between so if you are set up this year as a sole proprietorship or partnership, you really should be speaking to a business attorney to see if this is the appropriate structure for your business.

The next two types of business structures are by far the most common: LLCs and corporations. If you are set up as an LLC, you may want to speak with you business lawyer and your business CPA to determine if this structure is correct ? especially as many times LLCs are taxed as either sole proprietorships or partnerships. If it is determined that you should move to 8055 E. Tufts Avenue, Suite 710, Denver, CO 80237 s-corporation or c-corporation or depending on if your business has changed since it was organized, your business attorney may advise that moving to a corporation is a good thing.

In most cases, if you are a corporation, you will not be thinking about changing entity types. However, with some of the new regulations under ObamaCare and depending on what happens with the tax changes and the fiscal cliff, you may want to have a discussion with your business lawyer and business CPA to see if for tax reasons an s-corp or c-corp is still appropriate.

As always, if you have any questions about your small business or need help with determining if you business structure is correct, please call me, your Denver small business lawyer, today at 720-258-6647.

Customer Service: Crucial to Business Success

Whatever industry you?re in, the key to your survival is to ensure repeat business ? and one of the best ways to do that, in today?s tough climate, is to ensure that your customer service is first class.

So when you?re putting your customer service policy together, what do you need to consider?

Keep your customer services policy clear

Lay out, in plain English, the rights of the customer and the responsibilities of the customer service staff. Have a clear flowchart or protocol that your staff can follow. Revise your policy regularly, once a year at least, and more often if something unexpected happens, like an interruption to your supply chain. Have a named ?sponsor? who writes the policy and is ultimately responsible for its update.

Ask your staff

Get input from your customer service staff. They?re the people who deal with the customers on a daily basis, so they can tell you what works, what doesn?t, and what?s changing.

New technology

Make use of new technology. If your customer has given you a mobile or cell phone number or an email address, use it to keep them updated. Specify how customers can be contacted in your policy ? consider having templates for emails or texts that can be adapted quickly.

Refunds and returns

You must include details on taking returns in your customer service policy and ensure that your staff understands how much they can authorize themselves, and when it?s necessary to refer queries to a supervisor. Make sure you include timescales so customers know what they can expect.

Train your staff

Staff should become familiar with the policy when they arrive at your business, during their induction, and whenever it changes. It doesn?t have to be sophisticated or time-consuming. A quick and simple e-mail or Internet link will be enough. Think about incorporating details of other useful training, like telephone skills, problem-solving and conflict resolution ? and in your customer service policy, include details of how staff access this training. As part of your policy, have regular training sessions and updates for staff about your products or services, and any discounts or special offers available. The better your staff know your products, the more they?ll be able to help.

Make it public

Have your policy freely available for the world to see on your website, or at least a summary.

We live in a world where service is becoming increasingly impersonal, and one where loyalty is rarely rewarded, so taking time to make your customers feel as if they?re special and valued can help to increase repeat business. We also live in a world where many in positions of political leadership and power have shown they can?t be trusted. Buck the trend, and make sure your company delivers.

Some of the world?s best-known business leaders, ranging from Bill Gates and Steve Jobs to Walt Disney, have built their success on great customer service. When you have a new client, great customer service and after-care can make a huge difference in your conversion rates from ?one time only? customers to those who keep coming back again and again.

Lev Raphael: Does Being Famous Mean You Don't Have to Write Well?

When I was the crime fiction reviewer for the Detroit Free Press, I noticed something strange in the reviewing world. My colleagues would rave about a mystery or thriller, but ignore the fact that it was badly written. I suspect that's what's going to happen with Dick Wolf's debut thriller The Intercept.

In case you don't recognize the name, Wolf is the Emmy-winning producer and creator of Law and Order. I was a devoted viewer of that show through almost all of its twenty seasons, happily watching reruns because I loved the characters, the stories, the New York settings and the dialogue. So I assumed that any book written by Wolf and set in New York would have to be terrific. Unfortunately, his vast skills don't seem to have transferred well to fiction. While there are some exciting scenes in the book, it's weighed down by sometimes amateurish prose.

Here are just a few examples:

"He felt her fingertips chewing into the tops of his shoulders."

"Fisk snapped the ring of circular logic that was squeezing his mind like a tourniquet."

"He was a classically handsome Arab. Dark eyebrows across the top of an angular square face, broad shoulders."

"Fisk had a tight feeling in his gut. A psychic scent."

"Jennsen sat deeply at the end of a suede-covered couch."

"He backed up his thought process again."

These aren't exceptions; surprisingly inept prose appears throughout The Intercept and makes the book read like a first draft, or as if nobody bothered to edit it carefully, because, well, he's Dick Wolf. The dialogue is often wooden, too, and so are many of the characters' reflections, as when an anti-terror cop responds to a mysterious coded terrorist message by concluding, "Something was coming." That's actually the last line of a section and is meant to be a cliff-hanger.

If the book had been carefully edited, Wolf also wouldn't have been allowed to make his secret terrorist painfully obvious from almost the minute that character appears. Wolf points away from the terrorist so insistently that it can't be anyone else, which is almost as big a letdown as the writing.

Library Journal called the book "spectacular" and gave it a starred review. Kirkus, Publishers Weekly and Booklist have also published hosannas. But why should crime fiction or thrillers be held to a different standard than other fiction? Why doesn't the way these books are written matter to enough reviewers?

I kept reading The Intercept out of morbid curiosity, wondering if the book could really be so flawed. Unfortunately, it is.

Gunman laid trap for firefighters in New York, killing two

At least two other firefighters and a passer-by were wounded. The volunteer firefighters were responding to a house fire likely set by the gunman, who killed himself after police responded.

By John Kekis,?The Associated Press / December 24, 2012

A fire burns near Rochester, New York. A gunman set the fire as a trap to lure in firefighters; he shot four, killing two early on Christmas Eve.

?A gunman ambushed four volunteer firefighters responding to an intense pre-dawn house fire Monday morning outside Rochester, N.Y., killing two, wounding two others and then killing himself, authorities said. Police used an armored vehicle to evacuate more than 30 nearby residents.

The gunman fired at the firefighters when they arrived shortly after 5:30 a.m. at the blaze near the Lake Ontario shore in Webster, town Police Chief Gerald Pickering said. The first Webster police officer who arrived chased the suspect and exchanged gunfire with him, authorities said.

"It does appear it was a trap" for the first responders to the fire, Pickering said at a news conference.

The gunman, William Spengler, had served more than 17 years in prison for beating his 92-year-old grandmother to death in 1980 at the house next to where Monday's attack happened, Pickering said. Spengler, 62, was paroled in 1998 and had led a quiet life since, authorities said. Convicted felons are not allowed to possess weapons.

Police say he set fire to a car and house to lure firefighters to his home on the shore of Lake Ontario. When they arrived, he opened fire from outdoors, probably with a rifle and from atop an earthen berm.

"He laid in wait with armament and shot first responders," Pickering said. Police don't know a motive yet.

Two firefighters, one of whom was also a town police lieutenant, died at the scene, and two others were hospitalized. A fifth man who was passing by was also injured. The police officer who exchanged gunfire with Spengler and "in all likelihood saved many lives," Pickering said.

Seven houses were destroyed in the blaze, Pickering said, and police have not been able to get inside the houses to determine if there are any more victims. They said Spengler's 67-year-old sister Cheryl Spengler was unaccounted for. He lived in the house with his sister and mother, Arline, who died in October.

For someone not running in Italy, Monti has a plan

Italian Premier Mario Monti gestures as he speaks during a news conference in Rome, Sunday, Dec. 23, 2012. Italy's caretaker Premier Mario Monti said Sunday he won't run in February elections, but if political parties that back his anti-crisis agenda ask him to head the next government he would consider the offer. Monti ruled out heading any ticket himself, saying "I have no sympathy for 'personal' parties." At a news conference, Monti made clear he was spurning an offer from his predecessor Silvio Berlusconi to run on a center-right election ticket backed by the media mogul, citing Berlusconi's heavy criticism of his economic policies. (AP) ? For someone not running for political office, Premier Mario Monti has an awfully detailed plan for how to fix Italy's financial woes and bring the country and the rest of Europe back to economic health.

Monti issued a 25-page agenda to "Change Italy, Reform Europe" late Sunday after announcing he had ruled out campaigning for February elections, but would consider leading the next government if politicians who share his focus on reform request it.

Monti outlined the steps Italy must take to finish the reforms his 13-month technical government launched to reign in Italy's public debt, spur economic growth and bring Europe's No. 3 economy out of recession.

Some of his priorities include attracting greater foreign investment, investing in research, exploiting Italy's cultural treasures and fighting tax evasion and corruption.

How to make a website: could Seth Godin be wrong? | Jojet ...

newport

Recently I read a thought provoking post from Seth Godin titled ?How to make a website: a tactical guide for marketers?; it didn?t sit comfortably with me so after letting it stew for a while I decided to make a rebuttal.

The aim of Seth?s article was to help business marketers communicate their website vision better so that the whole process went smoother and, ultimately, the website appeared quicker. Fair enough. However, there were some flaws in his advice.

Be careful what you wish for?

The gist of Seth?s advice was this:

Let?s make the process take less time and be less hassle. Browse other websites and find the tech elements you want for your website (a shopping cart like this, a homepage like that), mockup the website in Keynote or Powerpoint and use that as your specification.

However, I have some issues here.

In my experience of designing websites, you have to be mindful of reaching for the tech too early. It?s all too tempting to be lured in and to spend time ?researching? what the competition are doing, and mistaking that for a strategy for deciding what your website needs (?ooh! look, their pages fip like a book..WE NEED THAT!?). What is right for one company and one website is not right for another. And who?s to say that the websites you are looking at are any good?! You could be copying poor websites & poor techniques; this is hardly laying the foundations for online success.

Where you should start

Competition research is fine and has its place but, in my experience, it is more important that the client brings the following to the table:

  • A clear idea of who they are & what their brand is
  • Who their audience is and what motivates them to buy
  • What products/services are they offering to their audience
  • The buying process of that audience

This is stuff which markers should know really well (but don?t always).

And this is a gold mine of information which savvy website design companies will use as a starting point so that collaboratively we can create a highly polished piece of online marketing collateral.

Straw Man

If you have established the above information then, by all means, go further and map out how you think this experience should manifest itself online (e.g. a sitemap or mocking something up in Powerpoint). BUT treat this as a straw man only.

And use your straw man to communicate your vision to your web design team but the conversation should not be ?this is how it should look? or too prescriptive full stop. A good web design team will work with you on what you are trying to achieve and, armed with that, they can advise you on how that may be best achieved online. Brow beat your web design team at your peril.

Seth says ?Virtually all websites are not on the cutting edge of technology.? true, but that?s like saying ?Virtually all recipes can be made using ingredients you can buy down a local supermarket?; ?the skill is in understanding what ingredients to bring to bear for the end result; the magic is not so much in the ingredients; it is in the knowledge of how to bring it all together using a creative process.

Collaborative

I don?t want to start every paragraph with ?Seth says? but?

Last step: Hand the Keynote doc to your developers and go away until it?s finished

This is dangerous, dangerous advice.

Online success is rarely achieved by business stake holders and design creatives working in isolation; it is more likely that it is achieved by working?collaboratively to bring your vision online. The process is iterative. And it needs input & ideas from various business stake holders along the way. Web design companies do not possess a crystal ball and if you want to avoid that awful moment when the curtain gets pulled back on the project and you start finding fault then I would advise you to be part of the process (yes, design has a regimented process) from day one. Design process is what achieves results; the design is just an output.

What you should concentrate on?

A word not mentioned once in the post is something which I would consider critical: content.

Without good content a website is dead in the water. And by cherry picking the process and trying to decide on (for example) what navigation system you think you need on your website, we run the risk of not concentrating on what we DO need to focus on. And that is the actual content of the website.

  • What content does the website need?
  • What form will that content take? (text, video, audio, infographic etc)
  • What content do we have already? (and what shape is it in?)
  • What new content do we need? Who will create it?
  • How will our content work on mobile?
  • How will we measure the effectiveness of our content?

Indeed, some website companies will push clients to create the content first before any further web design is done; concentrating the mind of the client on creating top quality content to engage their audience. Once we understand the message we can see how it needs to be applied to the medium.

Cutting corners

Seth suggests that in following his advice you will achieve results with ?less time and less hassle?. However, be careful on the corners you cut, quality results require time & effort.

Perhaps I misunderstood the advice offered in his article but, if I did, my concern is that other people will have misunderstood as well.

Joel

p.s. one good bit advice from the post was ?Don?t do any coding.?, however, to me this is self evident. It?s like saying ?Unless you are a qualified dentist, don?t perform your own root canal work?.

p.p.s part of me suspects that Seth knew his article would raise eye brows in certain quarters; perhaps he is not adverse to link bait ;)

'Smart-Tattoos': How They Could End Up Saving Your Life

So they?re not exactly cute, but if you came of age during the 90s, chances are you have at least regrettable tattoo anyway. (Raise your hand if that same tattoo is in the shape of a butterfly!)?? But the latest temporary tattoos do much more than serve as a symbol of misspent youth; they can read a body?s internal processes and alert the user of potential dangers like a dip in blood sugar or a drop in kidney function? all without having to draw any blood.

A recent collaboration between researchers at the University of California San Diego and the University of Toronto created a lightweight and stick-on ?smart tattoo.? Embedded in its fibers are a set of ?ion-selective electrodes? which is a cooler way of saying ?sensors that detect the pH or salt levels of the skin, as well minerals like potassium, and even blood oxidation."

In other words, it can monitor athletic performance at a granular level, but without any of the bulk or wiring of older sensors. It also means that for the first time, detailed athletic response testing would no longer be limited to the walls of a sports clinic, but could be done daily by the athlete herself. And because the stick-ons are both quick and cheap to produce, it seems a natural fit with a mass market roll-out. Researchers are hoping they?ve designed the next big thing in sports training and expect it to hit shelves within the next twelve months.

MORE: One in Ten Adults Will Be Diabetic in 20 Years

But this athletic testing sensor is only the latest iteration of a variety of body-reading tattoos set to hit the market in the coming year.

Sano Intelligence is in the testing phase of a smart tattoo that reads a wearer?s blood markers. The application would be particularly useful for diabetics, who need to keep strict control over their blood sugar levels and often have to resort to finger-prick tests to determine if those levels are within normal range. The Sano patch would not only allow them to forgo the pain of finger-pricks, but the constant hassle of dragging around testing devices and interrupting daily activities to draw their own blood.

And Boston-based MC10 announced earlier this year that it would soon release its own ?stretchable electronics? patch, that can be applied internally to human organs, or externally to human skin, or clothing, depending on what needed to be monitored. ?The stick-on?s ability to remain flexible while reading vital signs means that it could effectively gauge the function of specific organs, track brain processes, and monitor more mainstream functions like heart rate, blood oxidation and body hydration.?

What's going to make the biggest difference in our daily lives as a result of this technology isn't even the technology itself- it's that for the first time, we as patients will be able to maintain our mobility and independence as we're being monitored. This presumably could mean it would be easier to catch oncoming deficiencies before they manifest any symptoms, and the distance between the patient and her specialist would no longer be a hinderance to treatment.

Do you think this kind of technology would be useful in your own life, or do you think that a sensor monitoring your vital signs is just too "sci-fi" for your taste?

Republicans aren't the only gun-control obstacle

Correction: A previous version of this story misstated the state Sen. Mary?Landrieu represents. It is Louisiana.

President Obama?s call for Congress to show the ?courage? to consider new gun-control laws was aimed at Republicans, but he faces challenges with members of his own party who have a history of cowering from the gun debate.

The shooting deaths of 20 children and six adults at a Connecticut elementary school last week exposed how divided Democrats have been on gun control. It also demonstrated that, along with the current president, Democrats have failed to champion reforms after previous acts of mass violence. While Republicans held the line on gun control, Democrats largely ducked, ever since they ratified the assault-weapons ban in 1994 and saw their majority in Congress disappear.

Gun-control advocates face familiar challenges in keeping Democrats unified. The most vulnerable Democratic senators in 2014 hail from rural states where hunting is popular and guns are ubiquitous: Mark Begich of Alaska, Mary Landrieu of Louisiana, Mark Pryor of Arkansas, Kay Hagan of North Carolina, Max Baucus of Montana, Tim Johnson of South Dakota, and Jay Rockefeller of West Virginia. (Sen. Joe Manchin, D-W.Va., who was staunchly pro-gun during his 2010 and 2012 campaigns but now says he?s open to a debate, is not up for reelection for another six years. Same with Joe Donnelly of Indiana, who is also reconsidering his opposition to gun control as he transitions from congressman to senator and doesn?t face another election until 2018.)

The evolutions underscore how polarized the country is over gun control. Republicans, many of whom hail from rural, gun-owning states and districts, and the smaller number of Democrats that represent like-minded parts of the country, are responding as much to their constituents as to the powerful National Rifle Association lobby when opposing measures that come before Congress.?

?There?s no question that the leadership of the party made a conscious decision years ago to walk away from the issue at all levels,? said Democratic lobbyist Steve Elmendorf, a top Capitol Hill adviser when the assault-weapons ban passed. ?They figured they weren?t getting any credit for it, and they were getting hurt. I do think the situation [in Connecticut] could change that.?

The changing political calculus for some Democrats on gun control is starkly exemplified by Chicago Mayor Rahm Emanuel, who recently boasted that he ?stood by [Bill] Clinton?s side? as a top adviser when he signed the 1994 assault-weapons ban.? But years later, Emanuel helped elect numerous pro-gun candidates--and bragged about their Second Amendment bona fides--as he spearheaded the Democratic takeover of Congress in 2006. He was President Obama?s chief of staff in 2010 when the Brady Campaign to Prevent Gun Violence handed the administration an ?F? for expanding gun rights and failing to reinstate the assault-weapons ban. Now, in the wake of the tragedy in Newtown, as the mayor of a city plagued by gun violence, Emanuel is touting the ban once again.

Another prominent Democrat, Sen. Kirsten Gillibrand of New York, underwent an even more dramatic conversion. As a member of the House representing a Republican-leaning upstate district in 2008, she voted to repeal a law that banned semiautomatic weapons in the District of Columbia and required gun owners to register their weapons and store them unloaded, with trigger locks. She earned an ?A? rating from the NRA. Even as gun-control advocates complained about her January 2009 appointment to the Senate, she told a newspaper reporter that she kept two rifles under her bed. ?If I want to protect my family, if I want to have a weapon in the home, that should be my right,? she said.

The makeover of the congresswoman from a conservative district to the senator of a liberal state began the next day, when staff said that the rifles were removed. Later that year, with the help of two former critics--New York Mayor Michael Bloomberg and Rep. Carolyn McCarthy, D-N.Y.--she sponsored legislation to crack down on illegal gun trafficking. The NRA downgraded her to an ?F.? ?She sounded like Annie Oakley, and now she?s somebody different,? complained her Republican challenger in 2010. Days after the shootings in Connecticut, she wrote a newspaper column pushing her gun-trafficking bill and other restrictions. ??Congress has ducked a serious national debate over commonsense gun laws for too long,? she wrote.

In the column, she describes meeting the parents of a slain 17-year-old in Brooklyn, N.Y., shortly after her Senate appointment and the near-shooting death of her friend, Rep. Gabrielle Giffords, D-Ariz., in 2011. ?Her former congressional district did not experience the same issues of gun violence,? explained her spokesman, Glen Caplin. ?For the last four years, as a statewide representative, Senator Gillibrand has been highly focused on solving the problems of the entire state, including gang and gun violence.??

Asked if she still owned the two rifles, Caplin said, ?I?m not going to get into this.?

A shift in public opinion could offer political cover. A new Pew Research Center poll finds that, by 49 percent to 42 percent, limiting gun ownership is viewed as more important than protecting gun owners. The survey marks the first time since Obama?s election that more Americans prioritized gun control over gun rights.

?We?re getting so many calls from state capitals and Capitol Hill, it?s overwhelming,? said Brian Malte, spokesman for the Brady Campaign to Prevent Gun Violence. ?This feels like it could be a tipping point.?

It?s been nearly two decades since President Clinton pushed the assault-weapons ban, strategically attached to a sweeping anticrime bill and a 10-year expiration date. The House passed it by only two votes, and even Democrats who voted no feared it would brand their party as antigun.

?We knew it was a politically devastating vote at the moment it passed,? said Patrick Griffin, who served as Clinton?s director of legislative affairs. ?They cleaned our clock in 1994. You can?t ascribe all of that to guns, but it was a factor.?

Guns were blamed again in 2000 when Democratic nominee Al Gore lost one of the closest presidential elections in history to Republican George W. Bush. As vice president, Gore backed the assault-weapons ban and cast a tie-breaking vote for a 1999 background check law. Just one more gun-friendly, Southern state--Arkansas, West Virginia, or even his home state of Tennessee--could have delivered the presidency to Gore, even without Florida.

Six years later, a handful of pro-gun candidates, including Joe Donnelly and Brad Ellsworth of Indiana, Heath Shuler of North Carolina, and Jason Altmire of Pennsylvania, helped Democrats take back the House. Once again, other factors contributed to the election results--the heated immigration debate, political scandals, and the unpopularity of the war in Iraq--but the success of pro-gun Democrats reinforced the party?s wariness of gun limits.

Anxious to protect their moderate members and the president?s reelection prospects, Democrats shied from high-stakes gun votes even after massacres at Virginia Tech and Fort Hood (although Republicans seized the House anyway in 2010), and after slayings at a meet-and-greet hosted by Rep. Giffords and in a movie theater in Aurora, Colo. ?It?s never been a simple Democrat versus Republican issue. It?s much more complicated than that,? Griffin said.

A former top aide to Obama and on Capitol Hill, Jim Papa, said that Republicans beholden to the gun lobby deserve the lion?s share of the blame for inaction on gun control.

?There has always been an overwhelming amount of Democratic votes for gun control and practically zero support from the other party, and the responsibility falls on the Democrats?? he asked. ?Opponents of gun control have confused the issue, confused assault weapons with hunting rifles, so there is peril for people who believe in one and not the other. The NRA successfully equated sensible, popular gun-safety legislation with taking away your shotgun.?

But even when Democrats controlled both legislative chambers during Obama?s first two years in office, they passed and he signed laws allowing visitors to carry loaded, concealed guns to national parks and permitting Amtrak passengers to stow guns in checked baggage. The assault-weapons ban was never taken up during Obama?s first term, which was consumed with trying to revive the economy, pass health care reforms, and end the wars in Iraq and Afghanistan.

?You don?t have an infinite amount of time and goodwill, and you have to pick some priorities,? said Griffin, the former Clinton aide. ?Postelection, after this horrific event, maybe there?s a moment when we can come to common ground. ?I?m not convinced of that, but it looks better than ever.?
